New York Gas Tax Overview
New York’s state tax on gasoline is 24.18¢ a gallon and 22.38¢ on diesel, the rate in force since January 1, 2026. That is the 40th-highest state gasoline tax of the 50 states and DC. Excise fixed at 8¢; the petroleum business tax is adjusted each January 1 from a petroleum price index, within ±5%.
With the federal 18.4¢, a gallon of gasoline carries 42.58¢ of per-gallon tax, so a 15-gallon fill-up includes about $6.39 of fuel tax whatever the pump price. New York's sales taxes also apply to gasoline and diesel and are prepaid by distributors. The state portion is a fixed 8¢ a gallon (8.75¢ in the Metropolitan Commuter Transportation District, Publication 718-F); county and city portions are 3% to 4.75% of the price (4.5% in New York City) or a fixed amount per gallon. These are not counted in the per-gallon rate or the state ranking above. County and city sales taxes on fuel vary by locality; some charge a fixed amount per gallon rather than a percentage.
The rate is due to be reset on January 1, 2027; the new figure is not published yet.
